We are not responsible or liable for the accuracy of the information provided to us by third parties and are not responsible for any third party's policies or practices. How We Use Your Personal Information
- Providing Products and Services. We use your personal information to provide you with the Services in order to perform our contract with you, including to process your payments, fulfill your orders, to send notifications to you related to you account, purchases, returns, exchanges or other transactions, to create, maintain and otherwise manage your account, to arrange for shipping, facilitate any returns and exchanges and to enable you to post reviews.
- Marketing and Advertising. We use your personal information for marketing and promotional purposes, such as to send marketing, advertising and promotional communications by email, text message or postal mail, and to show you advertisements for products or services. Children’s Data
The Services are not intended to be used by children, and we do not knowingly collect any personal information about children. As of the Effective Date of this Privacy Policy, we do not have actual knowledge that we “share” or “sell” (as those terms are defined in applicable law) personal information of individuals under 16 years of age.

International Users
Please note that we may transfer, store and process your personal information outside the country you live in, including the United States. Your personal information is also processed by staff and third party service providers and partners in these countries.
If we transfer your personal information out of Europe, we will rely on recognized transfer mechanisms like the European Commission's Standard Contractual Clauses, or any equivalent contracts issued by the relevant competent authority of the UK, as relevant, unless the data transfer is to a country that has been determined to provide an adequate level of protection.

Act 25 Compliance
1. Contexte
Certified Cartridges is company that deals with personal information in the course of its activities.
This policy is aimed at ensuring the protection of personal information and outlining how Certified Cartridges collects, uses, discloses, retains, and disposes of or otherwise manages it. Furthermore, it aims to inform anyone interested about Certified Cartridges handles their personal information. It also covers the processing of personal information collected by Certified Cartridges through technological means.
2. Application and Definitions
This policy applies to Certified Cartridges, which notably includes its executives, employees, consultants, volunteers, as well as anyone else who provides services on behalf of Certified Cartridges. It also applies to Certified Cartridges's website and all websites controlled and maintained by Certified Cartridges.
It encompasses all types of personal information managed by Certified Cartridges, whether it pertains to its clients, potential or current, its consultants, employees, members, or any other individuals (such as visitors to its websites or others).
For the purposes of this policy, personal information refers to information concerning an individual that allows for their direct or indirect identification. For example, it could include a person's name, address, email address, phone number, gender, or banking information, as well as information about their health, ethnic origin, language, etc.
Sensitive personal information refers to information where there is a high degree of reasonable privacy expectation, such as health information, banking details, biometric information, sexual orientation, ethnic origin, political opinions, religious or philosophical beliefs, etc.
In general, a person's professional or business contact information does not constitute personal information. For example, a person's work-related information like their name, title, work address, work email, or work phone number does not fall under personal information. More specifically, and for the sake of precision, as per the Private Sector Privacy Act of Quebec, effective from September 22, 2023, Sections 3 (collection, use, disclosure), 4 (retention and disposal), and 6 (data security) do not apply to a person's information related to their role within a company, such as their name, title, position, as well as the address, email, and phone number of their workplace.
These same paragraphs also do not apply to personal information that is considered public under the law, starting from the effective date of this policy.
3. Collection, Use, and Disclosure
In the course of its activities, Certified Cartridges may collect various types of information for different purposes. The types of information Certified Cartridges may collect, their use (or the intended purpose), and the methods by which the information is collected are outlined in Appendix A of this policy.
Certified Cartridges will also inform individuals, at the time of collecting personal information, of any other information being collected, the purposes for which it is being collected, and the means of collection, in addition to any other information required by law.
Certified Cartridges adheres to the following general principles regarding the collection, use, and disclosure of personal information:
Consent:
- In general, Certified Cartridges collects personal information directly from the individual with their consent, unless an exception is provided for by law. Consent can be obtained implicitly in certain situations, such as when the individual decides to provide their personal information after being informed by this policy about its use and disclosure for the purposes specified (see Appendix A for more details). Thus, this policy and the information it contains can be accessed by the individual at the time of collecting personal information.
- Normally, Certified Cartridges must also obtain the consent of the individual before collecting their personal information from third parties, before disclosing it to third parties, or for any secondary use. However, Certified Cartridges may act without consent in certain cases allowed by law and under the conditions prescribed by it. The main situations where Certified Cartridges may act without consent are outlined in relevant sections of this policy.
Collection:
- In all cases, Certified Cartridges only collects information if there is a valid reason to do so. Additionally, the collection will be limited to the information necessary to fulfill the intended purpose.
- Please note that Certified Cartridges's services and programs are not intended for minors, and Certified Cartridges does not intentionally collect personal information about minors (in such cases, information cannot be collected from them without the consent of a parent or guardian).
- Collection from Third Parties: Certified Cartridges may collect personal information from third parties. Unless an exception provided for by law applies, Certified Cartridges will request the consent of the individual before collecting their personal information from a third party. In cases where information is not collected directly from the individual but from another organization, the individual can request the source of the information collected by Certified Cartridges.
In certain situations, Certified Cartridges may also collect personal information from third parties without the consent of the individual if it has a legitimate and substantial interest to do so, and a) if the collection is in the individual's interest and it is not possible to collect it from them in a timely manner, or b) if this collection is necessary to ensure the accuracy of the information.
Furthermore, Certified Cartridges may collect personal information indirectly, including through:
- Shopify: Shopify has its own terms and their privacy policy, which can be consulted for more information.
- Hubspot: Hubspot has its own terms and their privacy policy, which can be consulted for more information.
- Klaviyo: Klaviyo has its own terms and their privacy policy, which can be consulted for more information.
Retention and Use:
- Certified Cartridges ensures that the information it holds is up-to-date and accurate at the time of use for decisions concerning the individual.

Certified Cartridges only use an individual's personal information for the purposes stated herein or for any other reasons provided at the time of collection. When Certified Cartridges wishes to use this information for another reason or purpose, new consent must be obtained from the individual, which must be obtained expressly if it pertains to sensitive personal information. However, in some cases provided for by law, Certified Cartridges may use the information for secondary purposes without the individual's consent, e.g. :
a) when such use is clearly to the individual's benefit;
b) when necessary to prevent or detect fraud;
c) when necessary to assess or improve security measures. - Limited Access: Certified Cartridges must implement measures to limit access to personal information only to employees and individuals within its organization who have the authority to access it and for whom this information is necessary in the course of their duties. Certified Cartridges will request the individual's consent before granting access to any other person.
Disclosure:
- Generally, unless an exception is specified in this policy or otherwise provided by law, Certified Cartridges will obtain the consent of the individual before disclosing their personal information to a third party. Additionally, when consent is required and it involves sensitive personal information, Certified Cartridges must obtain explicit consent from the individual before disclosing the information.
- However, disclosure of personal information to third parties is sometimes necessary. Thus, personal information may be disclosed to third parties without the consent of the individual in certain cases, including but not limited to the following:
a) Certified Cartridges may disclose personal information, without the consent of the individual, to a public body (such as the government) that collects it through its representatives in the exercise of their duties or the implementation of a program they manage.
b) Personal information may be transmitted to service providers to whom it is necessary to disclose the information without the individual's consent. For example, these service providers may include event organizers, subcontractors designated by Certified Cartridges for the execution of mandates in programs administered by Certified Cartridges, and cloud service providers. In these cases, Certified Cartridges must have written contracts with these providers that outline the measures they must take to ensure the confidentiality of the personal information disclosed, that the use of this information is only for the purpose of executing the contract, and that they cannot retain this information after its expiration. Additionally, these contracts must stipulate that the providers must notify Certified Cartridges's privacy officer (as indicated in this policy) of any breach or attempted breach of confidentiality obligations regarding the disclosed personal information and allow this officer to conduct any necessary verification related to this confidentiality. - If necessary for the conclusion of a commercial transaction, Certified Cartridges may also disclose personal information, without the consent of the individual, to the other party to the transaction and subject to the conditions provided by law.
- Disclosure Outside Quebec: Personal information held by Certified Cartridges may be disclosed outside Quebec, for example, when Certified Cartridges uses cloud service providers whose servers are located outside Quebec or when Certified Cartridges deals with subcontractors located outside the province.

Use of Cookies Cookies are data files transmitted to a website visitor's computer by their web browser when they visit a website and can serve various purposes.
Websites controlled by Certified Cartridges use cookies, including:
- To remember visitor settings and preferences, such as language choice, and to enable tracking of the current session.
- For statistical purposes, to understand visitor behavior, the content viewed, and to improve the website.
Websites controlled by Certified Cartridges use the following types of cookies:
- Session Cookies: These are temporary cookies that are stored only for the duration of the website visit.
- Persistent Cookies: They are stored on the computer until they expire and will be retrieved during the next website visit.
Some cookies may be disabled by default, and visitors can choose whether to activate these functions during their visit to Certified Cartridges websites.
It is also possible to enable or disable the use of cookies by changing preferences in the browser settings.
- Use of Google Analytics
Certified Cartridges websites use Google Analytics to facilitate continuous improvement. Google Analytics allows for the analysis of how a visitor interacts with an Certified Cartridges website. Google Analytics uses cookies to generate statistical reports on the behavior of visitors to these websites and the content they view.
Information obtained from Google Analytics will never be shared by Certified Cartridges with third parties.
It is possible to install a browser add-on to disable Google Analytics.
- Other Technological Means Used
Certified Cartridges also collects personal information through technological means such as web forms integrated into a website controlled by Certified Cartridges (for example, its contact form, membership application form, newsletter and registration form), online questionnaires accessible on its platforms and applications, as well as other platforms or form tools (e.g., Microsoft Forms).
If Certified Cartridges collects personal information by offering a technological product or service that has privacy settings, Certified Cartridges must ensure that these settings provide the highest level of privacy by default (cookies are not targeted).
4. Retention and Destruction of Personal Information
Unless a minimum retention period is required by law or applicable regulations, Certified Cartridges will retain personal information only for the duration necessary to fulfill the purposes for which it was collected.
Personal information used by Certified Cartridges to make a decision regarding an individual must be retained for a minimum period of one year following the relevant decision or even for seven years after the end of the fiscal year in which the decision was made if it has tax implications, such as employment termination circumstances.
At the end of the retention period or when personal information is no longer needed, Certified Cartridges will ensure:
a) to destroy it; or
b) to anonymize it (meaning that it can no longer be used to identify the individual irreversibly, and it is no longer possible to establish a link between the individual and the personal information) for legitimate and serious purposes.
The destruction of information by Certified Cartridges must be carried out securely to ensure the protection of this information.
This section may be supplemented by any policy or procedure adopted by Certified Cartridges regarding the retention and destruction of personal information, if applicable. Please contact Certified Cartridges's privacy officer (as indicated in this policy) for further information.
5. Certified Cartridge's Responsibilities
In general, Certified Cartridges's is responsible for the protection of the personal information it holds.
The privacy officer for Certified Cartridges is the organization's Director of Operations. This individual is responsible for ensuring compliance with applicable privacy legislation and must approve policies and practices governing the governance of personal information. Specifically, this person is tasked with implementing this policy and ensuring that it is known, understood, and followed. In the absence or inability to act of this privacy officer, the President of Certified Cartridges will assume the responsibilities of the privacy officer.
Certified Cartridges staff members who have access to personal information or are otherwise involved in its management must ensure its protection and comply with this policy.
The roles and responsibilities of Certified Cartridges employees throughout the lifecycle of personal information may be further specified by any other Certified Cartridges policy in this regard, if applicable.
6. Data Security
Certified Cartridges is committed to implementing reasonable security measures to ensure the protection of the personal information it manages. The security measures in place correspond to, among other things, the purpose, quantity, distribution, format, and sensitivity of the information. This means that information that can be classified as sensitive (see the definition provided in section 2) should be subject to more significant security measures and must be better protected. In particular, and in accordance with what was mentioned earlier regarding limited access to personal information, Certified Cartridges must implement necessary measures to impose constraints on the rights of use of its information systems so that only employees who need access are authorized to access them.
7. Access, Correction, and Withdrawal of Consent Rights
To exercise their rights of access, correction, or withdrawal of consent, the individual concerned must submit a written request to the privacy officer of Certified Cartridges, at the email address provided in the following section.
Subject to certain legal restrictions, individuals have the right to request access to their personal information held by Certified Cartridges and request its correction if it is inaccurate, incomplete, or ambiguous. They can also demand the cessation of the dissemination of personal information concerning them or the removal of any hyperlink associated with their name that allows access to this information through technological means when the dissemination of such information violates the law or a court order. They can do the same, or demand that the hyperlink allowing access to this information be reindexed, when certain conditions specified by law are met.
Certified Cartridges's privacy officer must respond in writing to these requests within 30 days from the date of receiving the request. Any refusal must be justified and accompanied by the legal provision justifying the refusal. In such cases, the response must indicate the remedies available under the law and the timeframe for exercising them. The privacy officer must assist the requester in understanding the refusal if necessary.
Subject to applicable legal and contractual restrictions, individuals can withdraw their consent for the communication or use of the collected information.
They can also request from Certified Cartridges what personal information has been collected from them, the categories of individuals within Certified Cartridges who have access to it, and the duration of its retention.
8. Complaint Handling Process
Reception
Any individual who wishes to file a complaint related to the application of this policy or, more generally, the protection of their personal information by Certified Cartridges, must do so in writing by addressing it to Certified Cartridges's privacy officer, at the email address provided in the following section.
The individual must provide their name, contact information, including a phone number, as well as the subject and reasons for their complaint, providing sufficient details for it to be evaluated by Certified Cartridges. If the complaint is not sufficiently precise, Certified Cartridges's privacy officer may request any additional information deemed necessary to evaluate the complaint.
Processing
Certified Cartridges is committed to handling any received complaints confidentially.
Within 30 days of receiving the complaint or after receiving all additional information deemed necessary and required by Certified Cartridges's privacy officer to process it, the privacy officer must assess it and provide a written, reasoned response by email to the complainant. This evaluation aims to determine whether Certified Cartridges's processing of personal information complies with this policy, any other policies and practices within the organization, and applicable laws or regulations.
In cases where the complaint cannot be processed within this timeframe, the complainant must be informed of the reasons justifying the extension, the status of the complaint's processing, and the reasonable timeframe required to provide a definitive response.
Certified Cartridges must maintain a separate file for each complaint received. Each file includes the complaint, the analysis, and supporting documentation for its evaluation, as well as the response sent to the complainant.
It is also possible to file a complaint with the Commission d'accès à l'information du Québec or any other privacy oversight body responsible for enforcing the law related to the subject of the complaint.
However, Certified Cartridges encourages anyone interested to first contact its privacy officer and wait for the completion of the processing process by Certified Cartridges.

10. Publication and Amendments
This policy is published on Certified Cartridges's website, as well as on all websites controlled and maintained by Certified Cartridges to which this policy applies, in relation to the personal information collected therein. This policy is also disseminated through any means capable of reaching the individuals concerned.
Certified Cartridges must also do the same for any amendments to this policy, which must also be subject to notice to inform the individuals concerned.
